1. About these terms

This website is operated by Sun And Sky Emlakçılık Ltd. Şti. ("Sun & Sky Real Estate", "we", "us"), registered at Gökevler Mahallesi 2312. Sokak No: 16/91, Esenyurt, İstanbul, Türkiye. By using the website or contacting us through our official channels, you accept these Terms of Use. If you do not agree, please do not use the website.

These terms govern use of the website and messaging channels only. Any brokerage, reservation, purchase or other service is governed by a separate written agreement, which prevails over these terms.

2. Listing and price information

Listings, prices, floor plans, sizes, photos, completion dates, payment plans and other property information on the website and in our messages are provided for general information and are indicative only. They are based on information from developers and owners and may change at any time without notice.

• Prices are shown as "starting from" and usually refer to the lowest-priced unit type; the final price depends on the specific unit, floor, view, payment plan and exchange rate, and may exclude taxes, title deed fees, VAT and other costs.
• A listing is not an offer or a guarantee of availability. A unit is reserved only after a written reservation or sale agreement.
• Images and visualisations may be illustrative and may differ from the delivered property.
• Always verify property details with the title deed, official documents and your own advisers before making a decision.

3. Citizenship, residence and legal information

Information about Turkish citizenship by investment, residence permits, taxes, rental yields, investment returns and legal procedures is general guidance and does not constitute legal, tax or financial advice. The rules are set and may be changed by Turkish authorities.

We do not guarantee that any application for citizenship, a residence permit, a visa, a title deed or a loan will be approved, or that a property will achieve a particular value or rental income. Decisions on applications are made solely by the competent authorities.

4. Messaging channels and AI assistant

Some replies on our WhatsApp, Instagram and Messenger accounts are generated or drafted by an AI assistant. AI replies may contain errors or be incomplete. They do not create a binding offer or commitment; only written confirmation from an authorised advisor or a signed agreement does. You can ask for a human advisor at any time.

5. Acceptable use

When using the website or our channels, you agree not to:

• provide false information or impersonate another person;
• send unlawful, abusive, defamatory or spam content;
• copy listings or content in bulk, scrape the website or use automated systems that place an unreasonable load on it;
• attempt to gain unauthorised access to, interfere with or test the vulnerability of our systems;
• use the website for any purpose that breaks Turkish law or the law of your country.

6. Intellectual property

The website design, texts, guides, logos, the Sun & Sky Real Estate name, and photos and videos we produce are protected by the Law on Intellectual and Artistic Works No. 5846 and the Industrial Property Law No. 6769. Some listing images belong to developers or other right holders. You may view and share pages for personal, non-commercial use; any other copying, reproduction or distribution requires our prior written permission.

7. Third-party services and links

The website may link to or embed third-party services such as WhatsApp, Instagram, Facebook, YouTube and map services. We are not responsible for their content, availability or privacy practices; their own terms apply.

8. Limitation of liability

The website is provided "as is" and "as available". We try to keep the information accurate and the website available, but we do not guarantee that it is complete, current, error-free or uninterrupted.

To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit or opportunity, or loss arising from reliance on website content or AI-generated replies without written confirmation. Nothing in these terms limits liability for gross negligence or wilful misconduct, or any liability that cannot be limited under Turkish law (including Article 115 of the Turkish Code of Obligations), or your mandatory rights as a consumer.

10. Changes

We may change these terms at any time by publishing a new version on this page. The version in force when you use the website applies.

11. Governing law and jurisdiction

These terms are governed by the laws of the Republic of Türkiye. Istanbul (Çağlayan) Courts and Enforcement Offices have jurisdiction over any dispute. If you are a consumer, this does not remove your right to apply to the consumer arbitration committees and consumer courts competent under Law No. 6502 on Consumer Protection, or any mandatory protection given by the law of your country of residence.

These terms are published in English and Persian. If there is a conflict between the versions, the English version prevails.
